The canceled school trip lawsuit is still in court

HUNTINGTON, W.Va. (WSAZ) – Two hundred and seventy-three families in Cabell County are still hoping to get their money back for a school trip to the nation’s capital that was lost due to the pandemic.

It all dates back to before the pandemic, in September 2019, when Barboursville and Milton middle schools signed contracts with the Eric A. Morrison travel agency.

Eighth graders were asked to pay $800 for a train ride and charter bus tour in Washington, DC, but the trip was canceled when the pandemic hit in early 2020.

The contract says no refunds, but Cabell County schools say they didn’t even go on the trip and should be reimbursed.

“Almost everyone, when you plan a big ticket trip, you get travel insurance. He was available,” said Clinton Smith, the defendant’s attorney.

“There should have been a refund,” said Cabell County Schools Attorney Thom Boggs. “The money spent by this travel agent has been refunded to this travel agent. He did not give money back to these families. Yes, there should have been a refund.”

On Tuesday, a Cabell County Circuit Court judge denied the travel agency’s attempt to force a court decision.

The civil trial in this case remains scheduled for January.
